Prof.
Jerry Tschura spoke at the International Trademark Association
130th Annual Meeting in Berlin May 17 - 21. The INTA Annual
Meeting attracts approx. 7,000 intellectual property practitioners
worldwide.
Prof. Tschura was part of an international
panel of law professors in a session entitled: "Freedom
of Expression and Unfair Competition: An International Academic
Perspective on the Boundaries of Fair Use."

The
panel took a comparative look at the laws surronding trademark
fair use. The discussion focused on use of another's trademark
in comparative advertising, internet keyword advertising
and parody with a critical look at fair use defenses and
barriers.
The participants in the panel included Prof. Ansgar
Ohly, (University of Bayreuth, Germany) Prof. Horacio Rangel
(Universidad Panamerica, Mexico) and Prof. Graeme Dinwoodie
(Chicago-Kent, U.S. and Queen Mary College, University of
London, U.K.) The panel moderator was Charles Gielen (University
of Groningen, the Netherlands) Approx 500 attended this session. |
